1. Acceptance of Terms

By accessing or using CLOUT Tracker you agree to be bound by these Terms & Conditions. If you do not agree with any part of these terms, please do not use the service.

2. Service Description

CLOUT Tracker is an AI-powered sports-tracking platform that allows users to:

Log and track sports activities
Earn points and medals based on a transparent formula
Compete in leagues with gold, silver and bronze tiers
Join public and private groups with leaderboards
Receive personalised recommendations powered by AI (Google Gemini)

3. Registration & Account

To use the full service you must create an account. By doing so, you agree to:

Provide accurate and up-to-date information
Keep your login credentials secure
Not share your account with other people or create fake accounts
Be at least 16 years of age
Notify us immediately if you suspect unauthorised access to your account

Accounts that provide false information or violate these terms may be suspended without notice.

4. Acceptable Use

The following activities are strictly prohibited:

Recording false or manipulated activity data
Attempting to manipulate the scoring system or leaderboard rankings
Harassing, threatening or abusing other users within the platform
Reverse-engineering, scraping or attempting to access the API without authorisation
Using the platform for any illegal or fraudulent purpose
Creating bots or automated scripts to generate artificial activity

Violations are detected automatically and reviewed by our moderation team. Accounts may be permanently banned.

5. Intellectual Property

Your Data

The activity data you log belongs to you. We process it solely to provide the service as described in our Privacy Policy. You may export or delete your data at any time.

Platform Intellectual Property

The CLOUT Tracker brand, logo, design, source code and all platform content are the exclusive property of CLOUT WEB SERVICES. Reproduction or commercial use without written permission is prohibited.

6. AI Features (Gemini API)

CLOUT Tracker uses the Google Gemini API to power intelligent features. By using these features you acknowledge and agree that:

AI-generated recommendations are informational and not a substitute for professional advice
Activity data is sent to Google in anonymised form solely to generate insights
AI responses may occasionally be inaccurate; always apply personal judgement
We continuously improve prompts and models to reduce errors

7. Limitation of Liability

CLOUT Tracker is provided "as is" without warranties of any kind.

We do not guarantee uninterrupted or error-free service availability
We are not liable for loss of data caused by technical failures
AI-generated recommendations do not constitute medical or sports-science advice
Our maximum liability is limited to the amount paid for the service in the past 12 months

8. Service Modifications

We reserve the right to modify, suspend or discontinue any part of the service at any time. We will provide reasonable advance notice of significant changes that affect core functionality. Continued use of the service after changes take effect constitutes acceptance of the updated terms.

9. Termination

By the User

You may delete your account at any time from the app settings. All your personal data will be removed within 30 days.

By CLOUT

We reserve the right to suspend or terminate accounts that violate these Terms & Conditions, without prior notice in cases of serious misconduct.

10. Governing Law

These Terms & Conditions are governed by Spanish law. Any disputes arising from the use of the service shall be subject to the jurisdiction of the courts of Spain, unless otherwise required by applicable consumer-protection legislation.
